Our team has guided many couples through mutual divorce in Delhi, from the first consultation and settlement drafting to the final decree. Familiarity with the paperwork the court expects, and with how petitions are listed, is often what keeps a straightforward mutual divorce moving instead of stalling on avoidable delays.

We take on a limited number of matters at a time so every client gets direct access to the lawyer handling their case, not a rotating handoff between juniors.

The mutual divorce process

How the mutual divorce process works in Delhi

Section 13-B of the Hindu Marriage Act follows a fixed sequence at the Delhi family courts, and requires that the spouses have been living separately for at least one year before the petition is filed. The Special Marriage Act, 1954 (Section 28) has a similar mutual consent route. Here's what to expect.

1

Consultation & document review

We review your documents, check eligibility (including the one-year separation requirement) and map the fastest realistic route for your case.

2

Settlement drafting & joint petition

We draft the settlement covering alimony, custody and property, and file the joint petition before the competent Delhi family court.

3

First motion & recorded statements

Both parties appear to record statements; the court admits the first motion.

4

Cooling-off period

Six months for reconciliation, waivable in qualifying cases — we file for this whenever it applies.

5

Second motion & decree

The court passes the final decree dissolving the marriage.

Questions from Delhi couples

Frequently asked questions

A mutual divorce is a divorce where both spouses jointly agree to end the marriage and settle alimony, custody and property between themselves. In India it is filed as a joint petition under Section 13-B of the Hindu Marriage Act, or Section 28 of the Special Marriage Act. Read more on our mutual divorce page.
In a mutual divorce, both spouses agree to separate and on all terms, and file a joint petition under Section 13-B. In a contested divorce, one spouse files on a legal ground such as cruelty or desertion and the other opposes, so it usually takes longer and costs more. See our page on contested divorce.
Fees depend on how many issues need settling, such as property, alimony or custody, and whether a cooling-off waiver is needed. We quote a fixed figure before starting. See the fees section above, or message us on WhatsApp for a quote.
There's no official ranking, but look for an advocate who is Bar Council-enrolled, handles family matters regularly, explains the process clearly and quotes a fixed fee upfront. Our guide on choosing a divorce consultant has more tips.
Choose a lawyer familiar with the family court that has jurisdiction over your case. Our chamber is at Dwarka Courts, Sector 10, and most consultations can be done over video, so you can work with us from anywhere in Delhi.
Typically 6–8 months including the statutory cooling-off period, though this can be shorter where the court permits a waiver.
Under Section 13-B of the Hindu Marriage Act, the spouses must have been living separately for at least one year before the joint petition is filed. The Special Marriage Act has a similar requirement. We check your eligibility during the first consultation.
Generally no. Under Section 14 of the Hindu Marriage Act, a divorce petition cannot be presented within one year of marriage, except with the court's leave in cases of exceptional hardship or exceptional depravity. Separately, Section 13-B requires the spouses to have lived separately for at least one year.
Yes, in appropriate cases. The Supreme Court has held that the period is not mandatory and the family court can waive it if the parties have been separated for a long time and settlement terms are in place. It remains at the court's discretion, and we file the application whenever your case qualifies.
In general, yes. Both spouses appear before the family court to record statements for the first motion and again for the second motion. In some situations, such as when a spouse lives abroad, courts may permit appearance through video conferencing. We tell you in advance how many appearances to expect.
Consultation, document sharing and drafting can all be done online, and our mutual divorce online process lets you start from anywhere. Court appearances still apply, but the court may allow video conferencing in suitable cases. We advise what is workable for your situation.
These are settled by the spouses themselves in a written settlement deed; there is no fixed formula. The court checks that the terms are voluntary, and the child's welfare is the priority in custody. Common terms include one-time or instalment alimony, return of stridhan, division of property, and custody and visitation. We draft these so they are clear and enforceable.
In a genuine mutual consent matter, one lawyer can draft the joint settlement, since both sides already agree on terms. If disagreements come up later, each spouse should have independent counsel.
Marriage certificate, address proof of both spouses, recent photographs, and a summary of shared property or assets. We'll tell you if anything else is needed for your specific case.
Consent must continue until the second motion, so either spouse can withdraw before the decree. If that happens, the case can be converted to a contested divorce. If your spouse stops appearing altogether, we can guide you on an ex-parte divorce filing.
